1. Scope of Agreement / 协议适用范围

This agreement applies to the student's participation in all tutoring, classes, camps, workshops, and activities, including online sessions and any off-site activities and transportation arranged by Lux Learning Inc., Lux Learning (Richmond) Inc., Lux Learning (Vancouver) Inc., Lux Discovery Inc., and Lux Education Consulting Inc., together with the other affiliated entities within the Lux Education Group (collectively, "Lux Learning", "we", "us", or "our"). It takes effect when accepted and remains effective for as long as the student is enrolled, until withdrawn in writing or replaced by an updated version, and we may request annual re-confirmation. Where the student is under 19, it must be accepted by a parent or legal guardian; a student 19 or older may accept for themselves. Lux Learning is not a school or licensed educational authority and does not replace the student's formal schooling, and except for supervision during scheduled program hours, no guardianship relationship is created. Admissions and education consulting services provided by Lux Education Consulting Inc. are governed by a separate written agreement and are not covered by this agreement; nothing here limits the protections in Sections 3 and 4 for any entity named.

本协议适用于学生参加由Lux Learning Inc.、乐学（Richmond）有限公司、乐学（Vancouver）有限公司、Lux Discovery Inc. 及 Lux Education Consulting Inc.，连同乐学教育集团旗下其他关联机构（统称“乐学”、“我们”）所提供的所有辅导、班级、夏令营、工作坊及活动，包括线上课程以及由乐学安排的任何校外活动与交通。本协议于接受时生效，并在学生在读期间持续有效，直至以书面方式撤回或被更新版本取代，我们可要求每年重新确认。学生未满19岁的，须由家长或法定监护人接受本协议；满19岁的学生可自行接受。乐学并非学校或持牌教育机构，不替代学生的正规学校教育；除在排定的课程时间内提供监管外，不构成任何监护关系。由Lux Education Consulting Inc.提供的升学与教育咨询服务受另行签署的书面协议管辖，不在本协议范围内；本协议任何内容均不限制第3条及第4条对上述任何机构的保护。

2. Assumption of Risk / 风险承担

Participation carries inherent and other risks, including travel to, from, and within our premises and any program location; use of furniture, equipment, materials, and shared spaces; interaction with staff, volunteers, guest speakers, and other students; physical activities and any off-site activities; transportation to and from off-site activities by carrier, staff vehicle, or public transit; food and beverages, including allergen exposure; and illness transmitted in a group setting. The parent or guardian (or adult student) understands and voluntarily assumes all risk of personal injury, illness, death, or loss of or damage to property arising from participation, including risks not specifically listed.

参与活动存在固有及其他风险，包括往返及在我方场所和任何活动地点内的行动；家具、设备、材料及共享空间的使用；与员工、志愿者、嘉宾讲者及其他学生的互动；体能活动及任何校外活动；通过承运人、员工车辆或公共交通前往及离开校外活动的交通；课程期间提供或食用的食物与饮料，包括过敏原接触；以及在群体环境中传播的疾病。家长或监护人（或成年学生）知悉并自愿承担因参与活动而产生的所有人身伤害、疾病、死亡或财产损失或损坏的风险，包括上文未具体列明的风险。

3. Release and Waiver / 免责与责任豁免

To the fullest extent permitted by law, the parent or guardian (or adult student) releases and discharges Lux Learning Inc., Lux Learning (Richmond) Inc., Lux Learning (Vancouver) Inc., Lux Discovery Inc., Lux Education Consulting Inc., and any other affiliated entity within the Lux Education Group, and their respective directors, officers, employees, contractors, instructors, volunteers, and agents (the "Releasees") from any and all claims, demands, actions, and liability for any loss, damage, injury, illness, or expense suffered in connection with the student's participation, including claims arising from the negligence of any of the Releasees, except for liability that cannot be waived or excluded under applicable law (including gross negligence, wilful misconduct, and matters governed by mandatory consumer or safety legislation).

在法律允许的最大范围内，家长或监护人（或成年学生）免除并解除Lux Learning Inc.、乐学（Richmond）有限公司、乐学（Vancouver）有限公司、Lux Discovery Inc.、Lux Education Consulting Inc.及乐学教育集团旗下任何其他关联机构，及其各自的董事、高级管理人员、员工、承包商、讲师、志愿者及代理人（“被免责方”）就与学生参与活动相关的任何损失、损害、伤害、疾病或费用所产生的一切索赔、要求、诉讼及责任，幕后包括因任何被免责方的疏忽而引起的索赔；但依据适用法律不可豁免或排除的责任除外（包括重大过失、故意不当行为，以及受强制性消费者或安全法规管辖的事项）。

4. Indemnification / 赔偿

To the fullest extent permitted by law, the parent or guardian (or adult student) agrees to indemnify and hold harmless the Releasees from any claim brought by or on behalf of the student, or by any third party, arising out of the student's conduct or any breach of this agreement, except to the extent the claim arises from the gross negligence or wilful misconduct of a Releasee.

5. Medical Information and Emergency Authorization / 医疗信息与紧急授权

In the event of injury or illness during any program or activity, the parent or guardian (or adult student) authorizes Lux Learning staff to administer or arrange first aid and, where staff reasonably consider it necessary, to call emergency services and arrange transport to a medical facility, at the parent or guardian's (or adult student's) cost. We will make reasonable efforts to contact the parent or guardian or emergency contact as soon as practicable. Where authorized on the registration form, staff may assist the student in using prescribed emergency medication the student carries.

如在任何课程或活动期间发生伤害或疾病，家长或监护人（或成年学生）授权乐学员工实施或安排急救，并在员工合理认为必要时呼叫紧急服务并安排送往医疗机构，相关费用由家长或监护人（或成年学生）承担。我们将尽合理努力尽快联系家长或监护人或紧急联络人。在注册表上获得授权的情况下，员工可协助学生使用其随身携带的处方急救药物。

6. Code of Conduct / 行为规范

Students are expected to follow staff instructions and behave respectfully toward staff, volunteers, and other students. Lux Learning may, acting reasonably, suspend or remove a student for conduct that is unsafe, disruptive, dishonest, or harmful to others. Where a student is removed for such conduct, the parent or guardian is responsible for arranging the student's collection, and fees for the affected program are handled under Section 8 and are not refundable on account of the removal.

学生应遵从员工指示，并对员工、志愿者及其他学生以礼相待。对于不安全、扰乱秩序、不诚实或危害他人的行为，乐学可在合理范围内暂停或开除学生。学生因此类行为被开除的，家长或监护人负责安排接回学生，相关课程的费用按第8条处理，且不因开除而退还。

7. Online Sessions / 线上课程

Where instruction is delivered online, the same conduct and release terms apply. The parent or guardian is responsible for the student's environment and supervision during online sessions. Sessions may be recorded for quality, training, and safeguarding purposes. Lux Learning is not responsible for interruptions caused by the student's internet, device, or third-party platform failures.

以线上方式授课的，同样适用上述行为规范与免责条款。家长或监护人负责学生在线上课程期间的环境与监管。课程可因质量、培训及安全保障目的而被录制。乐学對因学生的网络、设备或第三方平台故障所造成的中断不承担责任。

8. Fees, Payment, and Cancellation / 费用、付款与取消

Programs are purchased and paid in advance as packages or blocks of hours. A scheduled session may be rescheduled without forfeiture only if at least 7 days' notice is given; with less than 7 days' notice, or a no-show, the session is forfeited. To withdraw from a program or stop future charges, the parent or guardian (or adult student) must give at least 14 days' written notice to the administration office. Any unused, prepaid balance remaining after that notice period will be audited and refunded or credited in accordance with these terms. All fees are in Canadian dollars unless stated otherwise.

课程以套餐或课时包形式预先购买并付款。如需改期，须至少提前7天通知，方可改期且该次课程不作废；若通知不足7天或缺席，则该次课程作废。如需退出课程或停止后续收费，家长或监护人（或成年学生）须向行政办公室提前至少14天以书面方式通知。该通知期满后剩余的未使用预付余额，将依据本条款进行审核，并予以退款或抵扣。除另有说明外，所有费用均以加元计算。

9. Program Changes / 课程变更

Lux Learning may substitute instructors, reschedule, relocate, move sessions online, or cancel a program, including for low enrollment or events beyond our reasonable control. Where we cancel a session we are unable to reschedule, we will provide a credit or refund for that session.

乐学可更换讲师、改期、变更地点、改为线上授课或取消课程，包括因报名人数不足或超出我方合理控制范围的事件。对于我方取消且无法改期的课程，我们将就该次课程提供抵扣或退款。

10. Materials and Intellectual Property / 教材与知识产权

Curriculum, materials, and assessments are owned or licensed by the Lux Education Group and are provided for the student's personal educational use only. They may not be copied, recorded, shared, or resold without our written permission.

课程、教材及测评由乐学教育集团拥有或获授权使用，仅供学生个人教育用途。未经我方书面许可，不得复制、录制、分享或转售。

11. Limitation of Liability / 责任限制

To the fullest extent permitted by law, and except for liability that cannot be limited under applicable law, the total aggregate liability of the Releasees in connection with the student's participation is limited to the total fees paid for the program that gave rise to the claim, and any claim must be brought within one year of the event giving rise to it.

在法律允许的最大范围内，且除依据适用法律不可限制的责任外，被免责方就学生参与活动所承担的责任总额，以引起索赔的课程已付费用总额为限，且任何索赔须在引起索赔的事件发生后一年内提出。

12. Privacy and Personal Information / 隐私与个人信息

Lux Learning collects the personal information on this form to enroll the student, deliver programs, respond to emergencies, and meet legal and administrative requirements. Personal information is handled in accordance with the Personal Information Protection Act (British Columbia) and may be shared with staff, affiliates within the Lux Education Group, and service providers engaged for these purposes. By accepting, the parent or guardian (or adult student) consents to this collection, use, and disclosure. Questions may be directed to our Privacy Officer at [email protected].

13. General / 一般条款

This agreement is governed by the laws of British Columbia and the federal laws of Canada applicable there. Any dispute will first be addressed by good-faith discussion and, failing resolution, may be pursued in the courts of British Columbia. If any part of this agreement is found unenforceable, the rest remains in effect. An electronic acceptance submitted through the Lux Learning registration system (TeachWorks) is valid and binding and has the same effect as a handwritten signature. This agreement, together with the registration form, is the entire agreement regarding the student's participation.

本协议受不列颠哥伦比亚省法律及加拿大适用于该省的联邦法律管辖。任何争议应首先通过善意协商解决；协商不成的，可向不列颠哥伦比亚省法院提起。本协议任何部分被认定为不可执行的，其余部分仍然有效。通过乐学注册系统（TeachWorks）提交的电子接受具有法律约束力，其效力等同于手写签名。本协议连同注册表，构成关于学生参与活动的完整协议。
